This document constitutes the General Terms and Conditions of Use of the Site (GTCUS). Access to, and all uses of, the Site imply unconditional acceptance of these terms and conditions of use.


Intellectual Property

The Site and its components, particularly images, trademarks such as 

« STARCK » or « Philippe STARCK », and the aesthetic aspects of objects displayed thereon are protected by the national, regional or international laws regarding Intellectual Property (here after, the Rights). Any total or partial reproduction of the Rights, display or dissemination by any process and on any medium whatsoever effectuated without PHS GENERAL DESIGN SCA’s express prior consent is prohibited and engages the liability of its perpetrator.

In conformity to article 4 of the Directive 2019/790, PHS GENERAL DEISGN SCA declares it opposes to all extractions for the purposes of text and data mining. All operations of extractions or mining of the Rights in particular by the assistance of automated processes to collect data are acts of infringement except the case where an agreement has been duly asked and expressly obtained under the conditions here after defined.

PHS GENERAL DESIGN SCA authorizes the setting of a hypertext link directing to the Site, provided that:

  •  the « embedded link » technique is not used so that the Site’s pages are not directly reproduced in a third party site;
  • the source is indicated, so that there is no confusion;
  •  this link is used for personal or informational purposes, excluding any commercial or advertising use. The authorization shall not be deemed to be for a use that is defamatory or contrary to the rules of law, in particular, any use violating Philippe Starck’s intellectual property rights.

In any event, PHS GENERAL DESIGN SCA disclaims any and all liability for any content of sites to which the Site might be affiliated by hypertext links or any other types of link.

Commitments and rights of users of the Site

Users of the Site commit to respect its integrity and refrain from causing a breakdown, alteration or any malfunctioning of the Site.

Users of the Site commit to use it in such a way that they do not provoke injury to a third party, PHS GENERAL DESIGN SCA and/or Philippe STARCK, especially by creating links with the Site for the purpose of disseminating false or defamatory information.

If they discover content that they think might violate their rights, the users may contact PHS GENERAL DESIGN SCA at the following address: http://www.starck.fr/contact, specifying the nature of the violation and the content deemed to be unlawful so that PHS GENERAL DESIGN SCA is able to change/delete the content if necessary.


Limitation of the Publisher’s liability

The Site may contain links directing to other sites that are not operated by PHS GENERAL DESIGN SCA. Under no circumstance shall PHS GENERAL DESIGN SCA be held accountable with respect to proper operation of such links or the content of third party sites. Nor shall PHS GENERAL DESIGN SCA be held liable for any damage due to connection to the Site or third party sites indicated thereon. In particular, PHS GENERAL DESIGN SCA does not guarantee the absence of viruses or any other elements that might be damaging to users of the Site, particularly to any of the infrastructures they use during connection to the Site.

PHS GENERAL DESIGN SCA does not guarantee continuous availability of the Site and its functionalities, and reserves the right to suspend the Site’s operation for maintenance, updating or other purpose that it deems appropriate.

Users of the Site do so under their own responsibility. PHS GENERAL DESIGN SCA shall not be held liable for any injurious consequences resulting from direct or indirect use of the Site, and shall not offer the users any guarantee with respect to use of the Site.

PHS GENERAL DESIGN SCA disclaims any and all liability for injuries a user incurs as a consequence of abnormal use or unlawful operation of the Site by said user or any other natural person or legal entity.


Updating

PHS GENERAL DESIGN SCA reserves the right to change the conditions for access to the Site and the conditions of use, which take effect immediately upon their dissemination. Consequently, the users are advised to regularly verify the content of these general terms and conditions of use in order to be familiar with the rules governing the Site.

Applicable law and jurisdiction

Unless otherwise specified in the legislation of the user’s country regarding public policy, these terms and conditions and any linkage via the Site with PHS GENERAL DESIGN SCA are governed by Luxembourg law. Any dispute that might arise regarding use of the Site, or which is related thereto, that cannot be resolved amicably, shall be submitted to the courts falling within the jurisdiction of Luxembourg city.

These terms and conditions are drawn up in English. In the event of a conflict between them and the French version, the French version shall prevail.


Confidentiality policy – Personal data protection

Personal data collected on the Site – i.e. surnames, given names and email addresses – are used for the management and transmission of our Newsletter, as are those collected in the contact form made available to users on the Site. PHS GENERAL DESIGN SCA commits to extend every effort to protect the personal data of users of the Site, particularly by making access to the data highly secure.

  • Use of personal data for transmission of the Newsletter :

The required personal data are stored on our servers and transmitted to our partner, Sendinblue, which stores them in our Sendinblue account for the sole purpose of managing the transmission of our Newsletter. These data are not transmitted to any other entity, and are used only for transmission of our Newsletter.

The data are retained on our servers and in the Sendinblue account for as long as you maintain your subscription to the Newsletter. In the event of cancellation of the subscription, the data remain on our server and in the Sendinblue account, but are no longer accessible. In accordance with the Personal Data Protection Regulation, you have the right to access, change, rectify, transfer and delete your data, which you may exercise by sending your request by email to the following address: http://www.starck.fr/contact.

  • Use of personal date collected in the contact form :

The required personal data are stored on our servers to enable the processing of your request. Your data are retained for a maximum period of one year.

PHS GENERAL DESIGN SCA does not transmit users’ personal data to third parties, unless the nature of the request requires the sharing of information with a third party. In that event, the user will be advised of this transmission, and it is up to him to oppose it within 2 (two) days following notification of the information. In the absence of opposition, PHS GENERAL DESIGN SCA will be free to transmit the user’s personal data to a third party, without PHS GENERAL DESIGN SCA being subject to any criticism by the user.
